If you’ve suffered an accident at work and sustained an injury as a result, it is likely that you may need some time off from work to recover. This may have an impact on your earnings and lead to financial stress on top of the concerns about your physical wellbeing. You might start to question how this accident could have been avoided and whether either you or your employer could have taken steps to prevent your injury. Once you have sought the necessary medical attention, it is important that you seek legal advice to ensure that you know where you stand.
Accidents at work happen, but that doesn’t mean that you should be expected to just get on with it if your employer could have prevented the incident. At Belmont Solicitors, we believe that you should not need to fear any kind of repercussions from your employer when you seek independent advice about an accident at work, as your workplace has a duty of care to all employees which includes a responsibility for health and safety. When an accident is reported, however minor, your employer should be assessing risks in the workplace. If they fail to do this, they put themselves at risk of further compensation claims, and you at risk of further injury.
If you are involved in an accident at work, we recommend that you report this in detail to your employer or health and safety department as soon as possible. Note down any evidence you can, such as taking pictures of the scene of the incident and writing down what happened to you. The more evidence you can collate to support your claim, the higher your chances of success in a claim.
Please be assured that your employer cannot dismiss or otherwise victimise you for making a claim. They are obliged to have suitable insurance cover in relation to workplace accidents to protect both you as the employee and the company if an accident should occur.
In Scotland, you have up to three years after an accident to make a claim. We do always recommend that you seek advice as soon as possible, however, in order to strengthen your claim. If the full extent of your injuries do not become clear right away, however, you can rest easy in the knowledge that you do have time to initiate your claim.
Belmont Solicitors can help you to make sense of the incident and can offer advice as to your next steps. Even if you didn’t report the accident immediately, or feel that you may have been able to partially prevent or mitigate your injury, we can help.
