The legal adult age in Scotland is 16; this means that if your child has experienced a personal injury due to no fault of their own when under 16, as a parent or guardian, you can start a claim as their litigation friend.

In Scotland, if the accident occurred at any time until the child’s 16th birthday, there is no time limit until they legally become an adult. After their 16th birthday, they have three years to start an injury claim. In some instances, the time limit does not apply, for example, when the pursuer does not have the mental capacity.
